The process of issuing a license in the National Agency of Mineral Resources
To obtain a license, the entrepreneur must submit the following documents to the LEPL National Agency of Mineral Resources' Licensing Department:
A statement, which must contain data on the type of resource to be extracted, the location and the validity period of the license (to be filled out in electronic form via the "rs.ge" website);
The X and Y coordinates of the license object;
In the case of a legal entity (LLC, JSC, etc.) - extracts from the state register, for an individual - an identity card;
in the case of private ownership of the territory provided for in the application - the owner's written consent to the issuance of the license (must be notarized)
The said application is electronically sent from the Licensing Department to the Mineral Resources Management Department (Geology) for review.
For the preparation of the Geoinformation package, the legislation prescribes the following timeframes:
● For the preparation of the geoinformation package within 45 calendar days in the case of thermal, fresh and mineral groundwater - 200 GEL, including VAT;
● For the preparation of the geoinformation package within 45 calendar days in the case of other types of mineral resources and when the area is up to 10 hectares - 400 GEL, including VAT;
● For the preparation of the geoinformation package within 45 calendar days in the case of other types of mineral resources and when the area is more than 10 hectares - 500 GEL, including VAT;
● For the preparation of the geoinformation package within 20 calendar days in the case of thermal, fresh and mineral groundwater - 500 GEL, including VAT;
● For the preparation of the geoinformation package within 25 calendar days in the case of other types of mineral resources and when the area is up to 10 hectares - 800 GEL, including VAT;
● For the preparation of the geoinformation package within 25 calendar days in the case of other types of mineral resources and when the area is more than 10 hectares - 1000 GEL, including VAT.
The Mineral Resource Management Department does a visual inspection of the area and prepares a geological report.
The application, along with the attached report, is returned to the Licensing Department, from where the appeal letter is sent to all relevant state institutions which owns or use the land, on which the license object is located (In the case of a water extraction license – also if the object crosses the fifteen-meter sanitary protection zone).
The mentioned institution expresses its position regarding the advisability of granting the license and in the case of a positive response, it is possible to set conditions for the future license, which must be taken into account when the subsequent licensing conditions will be drafted.
The licensing authority determines a period of 5 working days for the submission of a response. However, if an entity involved in the process requires additional time to present its position, he must notify the licensing authority thereof within no later than 3 days from the receipt of the notification, by means of an interim notice and with appropriate justification. Additionally requested time shall not exceed 5 working days. If, within the timeframe established by the licensing authority, no comments or reasoned refusals are submitted by the
relevant administrative bodies concerning the issuance of the license, the matter shall be considered agreed upon with the respective administrative body, and the Agency shall be authorized to make the relevant decision within the timeframes set by law.
The application, with the attached conclusion, is returned to the licensing department, from where the question is sent to all the state institutions that use the land on which the licensed facility is located (in the case of a water extraction license - also if the facility crosses a 15-meter sanitary protection zone).
The mentioned institution takes a position regarding the expediency of issuing a license, and in case of a positive answer, it is possible to define conditions for the future licensee, which should be taken into account when drawing up the license conditions.
After a positive decision is made, the prepared information will be published electronically on the website - www.eauction.ge and an auction will be announced, in which all interested persons may participate.
For the purpose of announcing an auction or deciding against announcing an auction for the issuance of a mineral extraction license, the general duration of the administrative proceedings shall not exceed four months.
Before the auction, participants have the opportunity to register on the web-page and pay the guarantee amount ("Advance Payment" - 10% or 50% of the initial amount and the fee - 200 GEL) within 15 days.
The auction winner must pay the remaining amount within 15 calendar days.
In case of non-payment of the amount within this period, he can pay the amount during the penalty period - during the next 15 working days, during which time he pays a fine of 1% of the amount to be paid for each overdue day.
The auction is considered to have failed if the mentioned obligation is not met.
The license-order is prepared in the agency on the 10th working day after the payment of the final amount.
After the end of the auction, there is an express license preparation service. In this case, it is possible to get a license on the day of the request for express service - 200 GEL, on the next working day - 150 GEL, and on the 4th working day - 50 GEL.
In addition to all the detailed information, the prepared license-order also contains conditions that the licensee must follow and fulfill.
The license-order is prepared electronically and sent to the licensee on the web page through "rs.ge".

The process of transferring a license in the National Agency of Mineral Resources
a) Extracts from the business register for a private legal entity and an individual entrepreneur, and for an individual - copies of documents confirming identification, as defined by the legislation. A legal entity under public law must attach certified copies of founding documents to the application;
b) relevant legal documentation confirming the transfer of the license, where the stock level to be transferred to the licensee will be reflected;
c) The X and Y coordinates of the licensed facility (transfer/remaining area).
d) Data: the amount of extracted resources and a report on license condition compliance; the license holder is responsible for the accuracy of this data.
In case of obtaining a license at the National Agency of Mineral Resources, the entrepreneur needs to contact the Agency's Licensing Department.
The entrepreneur submits an application to the Licensing Department of LEPL National Agency of Mineral Resources, which must contain the necessary documentation for obtaining a license.
